1. Agreement to Terms

1.1. These service terms (hereinafter referred to as the "Terms") constitute a legally binding agreement between you and INUTAN Limited (hereinafter referred to as "we," "us," or "INUTAN") regarding your access to and use of our game "OverField" (including all its features, content, and related services, collectively referred to as the "Service").

1.2. By accessing, downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

1.3. We reserve the right to modify these Terms at our sole discretion at any time. Modified Terms will be published within the Service or on our website. Your continued use of the Service after the effective date of the modifications constitutes your acceptance of the modified Terms.

2. Eligibility and Accounts

2.1. Age Requirements: If you are a "Child" (as defined below), you may not use the Service unless your parent or guardian ("Parent") has agreed to these Terms on your behalf.

* In the European Economic Area (EEA), a "Child" is a person under the age of 16, or the higher age required by their country of residence for consent to the processing of personal data.

* In South Korea, a "Child" is a person under the age of 14.

* In other regions, a "Child" is typically a person under the age of 13, or the higher age required by their country of residence for consent to the processing of personal data.

* Certain services may allow Children to participate after a Parent provides and verifies consent through a specific process (e.g., Niantic Kids Parent Portal). Parents should supervise their Children's online activities.

2.2. Account Security: You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. INUTAN is not liable for any damage or loss arising from unauthorized access to your account.

3. Rules of Use

3.1. Prohibited Conduct: You agree not to:

* Cheat: Modify, interfere with, or attempt to disrupt the normal operation or rules of the Service in any way, including but not limited to: using unauthorized third-party software, operating multiple accounts ("smurfing") within the same service, sharing accounts, using any technology to fake or alter your device's location (e.g., GPS spoofing), or selling/trading accounts.

* Publish or provide any content that is illegal, infringing, defamatory, insulting, threatening, harassing, hateful, or racially discriminatory.

* Trespass or attempt to enter property or locations where you do not have the right to enter.

* Engage in any activity that could lead to injury, death, property damage, or any form of legal liability.

3.2. Safety and Interactions: When using the Service, please be aware of your surroundings and interact with other players and the public in a safe and respectful manner. You assume all risks associated with your use of the Service.

4. Virtual Goods and Content

4.1. Virtual Goods: The Service may offer virtual currency, virtual goods, and/or services (collectively, "Virtual Goods") that require your purchase. These Virtual Goods represent a limited, personal, non-exclusive, non-transferable, non-sublicensable license granted to you, and are not tangible assets or property rights that you own. INUTAN reserves the right to manage, regulate, control, modify, and/or eliminate Virtual Goods at any time.

4.2. Probability-based Items: If the Service includes Virtual Goods obtained through random mechanisms (e.g., "gacha" or "loot boxes"), we will publish the acquisition probabilities within the game or on the official website. In regions with strict regulations on probability-based items, such as South Korea, we will comply with local laws regarding probability disclosure.

5. User-Generated Content

5.1. If the Service allows you to upload, submit, store, send, or receive content and data ("User Content"), you retain ownership of any intellectual property rights you hold in that content.

5.2. By submitting User Content, you grant INUTAN a worldwide, royalty-free, sublicensable, and transferable license to use, host, store, copy, modify, create derivative works from, distribute, publish, and display such content to operate, promote, and improve our Services.

6. Privacy

6.1. We collect, use, and share your personal information in accordance with our Privacy Policy. Our Service is designed to enable you to interact with a shared game world integrated with real-world information, which requires us to process your information, but we will only do so where we have a legal basis. Please read our Privacy Policy carefully for details.

7. Disclaimer and Limitation of Liability

7.1. Disclaimer: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, INUTAN expressly disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.2. Limitation of Liability: To the maximum extent permitted by law, INUTAN, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising out of or relating to these Terms or the Service.

8. Country-Specific Additional Provisions

8.1. Republic of Korea Users

If INUTAN meets the specific conditions stipulated by the Korean Game Industry Promotion Act and its enforcement decree (e.g., reaching certain thresholds for global sales or the number of Korean users), we will appoint a Domestic Agent in the Republic of Korea as required by law. The Domestic Agent's details (name/company name, address, valid contact information) will be clearly disclosed in our user agreements and privacy policy. The Domestic Agent will be responsible for fulfilling the compliance obligations under the Game Industry Promotion Act, including information disclosure for probability-based items, and will serve as the contact point for relevant Korean authorities.

8.2. European Economic Area (EEA) and United Kingdom Users

If you are a consumer in the EEA or the UK, you possess statutory rights that cannot be diminished by contract. Nothing in these Terms is intended to affect these rights. Regarding the processing of personal data, our Privacy Policy details the legal basis on which we process your personal data as a data controller.

8.3. Germany Users

Specific liability limitation provisions for users in Germany shall adhere to the mandatory provisions of German law.

8.4. Indonesia Users

Specific terms for users in Indonesia shall adhere to the mandatory provisions of Indonesian law.

9. Dispute Resolution and Choice of Law

9.1. Governing Law: The interpretation and application of these Terms shall be governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.

9.2. Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be attempted to be resolved by the parties through friendly negotiations. If the dispute cannot be resolved through negotiation, it shall be submitted to arbitration in Hong Kong in accordance with the Hong Kong International Arbitration Centre's Arbitration Rules. The arbitral award is final and binding upon both parties.

9.3. Class Action Waiver: The parties agree that any arbitration or lawsuit shall be conducted only on an individual basis and not as a class action, consolidated class action, or representative action (including a private attorney general action). Both parties waive the right to participate in a class action.

10. Miscellaneous

10.1. Entire Agreement: These Terms and any policies we reference (such as the Privacy Policy) constitute the entire agreement between the parties concerning the Service.

10.2. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

10.3. Assignment: INUTAN may assign these Terms, in whole or in part, without your consent, to an affiliate or in connection with a merger, acquisition, or sale of all or substantially all of its assets. You may not assign these Terms or transfer any of your rights.
